The process for notarizing your living trust is as follows:

  • 1 .  Have the completed document printed and ready. Do not sign anything until your notary is there to witness.
  • 2 .  All signers must be present and physically appear before the notary. With a living trust, there will typically be the grantor, the trustee, any successor trustees if applicable, and two witnesses who are not named in the trust.
  • 3 .  All the signers will present a valid photo ID to the notary. 
  • 4 .  All the signers can sign in their designated sections on the trust while your notary witnesses.
  • 5 .  Your notary will ask for verbal confirmation that all signers understand the contents of the document and that they are signing of their own free will.

When does the living trust go into effect?

The living trust is active after it has been notarized and is effective while the grantor is still living.

What should I do with my living trust after it's notarized?

It's recommended that you keep the original living trust document stored safely, for example in a safe deposit box at the bank where you can check the contents periodically. Let the trustee know its location and how to access it when necessary. If you have an estate lawyer, they should have a copy.
